OVERVIEW
Welcome to Alpha Moms LLC. The terms "we", "us", and "our" refer to Alpha Moms LLC. We operate mafiamoms.shop and the related information, content, features, tools, products, and services made available through the website (collectively, the "Services").
Our online store is powered by Shopify. Purchases made through our store are transactions between you and Alpha Moms LLC.
These Terms of Service ("Terms"), together with the policies referenced below, govern your access to and use of the Services and purchases made through our store.
By accessing or using the Services, you agree to these Terms to the extent permitted by applicable law. If you do not agree, you should not use the Services.
These Terms should be read together with our Privacy Policy, Return & Refund Policy, and Shipping Policy.
SECTION 1 — ELIGIBILITY AND ACCOUNTS
You must have legal capacity to enter into a binding transaction under applicable law or make purchases with the involvement and authorization required by applicable law.
When using the Services or placing an order, you agree to provide current, complete, and accurate information.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account, except to the extent applicable law provides otherwise.
SECTION 2 — PRODUCTS
We make reasonable efforts to describe and display our products accurately. However, colors and appearance may vary depending on your device, screen, display settings, production process, and other factors.
Product descriptions, availability, designs, specifications, and other product information may be changed where reasonably necessary and permitted by applicable law.
We may discontinue products or limit quantities or availability, subject to orders already accepted and any obligations imposed by applicable law.
Nothing in this section excludes or limits mandatory rights relating to goods that are defective, unsafe, misdescribed, non-conforming, or otherwise protected by applicable consumer law.
SECTION 3 — ORDERS AND CONTRACT FORMATION
Submitting an order constitutes an offer to purchase the products identified in your order.
We may accept or decline an order, subject to applicable law. Receipt of an automated order confirmation does not necessarily mean that an order has been finally accepted if further payment, fraud, inventory, production, or order verification is reasonably required.
If we decline or cancel an order after payment has been collected, we will provide an appropriate refund for the affected amount.
Please review your order carefully before submitting it. Because many of our products are made to order, production may begin shortly after an order is accepted.
Cancellation, return, withdrawal, replacement, and refund rights are governed by our Return & Refund Policy and any mandatory rights provided by applicable law.
SECTION 4 — PRICES, PAYMENT, TAXES, AND CHARGES
Prices are displayed before purchase and may change from time to time. Changes do not retroactively alter the price of an order already accepted, except where correction is permitted or required by applicable law.
You agree to provide accurate billing and payment information and represent that you are authorized to use the payment method submitted.
Applicable taxes and charges will be handled as displayed at checkout or as otherwise required by law.
Eligible U.S. orders receive free standard U.S. shipping as described in our Shipping Policy. Optional upgraded shipping services may carry an additional charge.
International orders may be subject to shipping charges, customs duties, import taxes, VAT, brokerage fees, or other charges as described in our Shipping Policy and as permitted by applicable law.
SECTION 5 — PRODUCTION, SHIPPING, AND DELIVERY
Many Alpha Moms products are made to order. Typical production and processing times, estimated transit times, tracking practices, international shipping information, and delay procedures are described in our Shipping Policy.
Shipping and delivery estimates are estimates unless expressly stated otherwise.
We do not use these Terms to impose a blanket transfer of risk of loss to consumers where doing so would conflict with applicable law.
Mandatory rights concerning shipment, delivery, delay, non-delivery, loss, or damaged goods remain unaffected.
SECTION 6 — RETURNS, REFUNDS, AND CONSUMER RIGHTS
Our voluntary return rules and regional return procedures are described in our Return & Refund Policy.
Nothing in these Terms or our policies excludes, restricts, or limits any consumer right, legal guarantee, statutory warranty, cancellation right, withdrawal right, refund right, or other remedy that cannot lawfully be excluded or restricted.
Consumers in the European Union, European Economic Area, United Kingdom, United States, Canada, and other jurisdictions may have rights under local consumer protection laws in addition to rights expressly described in our policies.
SECTION 7 — INTELLECTUAL PROPERTY
The Services and their content, including trademarks, brand elements, text, graphics, photographs, artwork, designs, video, audio, and website presentation, are owned by or licensed to Alpha Moms LLC or applicable third parties and are protected by applicable intellectual property laws.
Subject to these Terms, you may use the Services for lawful personal, non-commercial purposes.
Unless permitted by law or expressly authorized by us, you may not reproduce, distribute, modify, create derivative works from, publicly display, republish, commercially exploit, or otherwise use protected content from the Services without appropriate authorization.
Alpha Moms LLC names, logos, designs, and other brand identifiers may be trademarks or other protected intellectual property. Shopify and other third-party names and marks belong to their respective owners.
SECTION 8 — THIRD-PARTY SERVICES AND LINKS
The Services may include functionality, applications, payment services, links, or other services provided by third parties.
Third-party services may be subject to separate terms and privacy policies. We are not responsible for independent third-party websites or services that we do not control, except where applicable law provides otherwise.
You should review the applicable terms and policies before using a third-party service.
SECTION 9 — SHOPIFY
Our store is powered by Shopify, which provides technology and commerce infrastructure used to operate the Services.
Products purchased from our store are sold by Alpha Moms LLC, not Shopify. Shopify may nevertheless process information or provide payment, commerce, security, infrastructure, or other services in connection with your use of our store.
Shopify's role and processing of personal information are further described in our Privacy Policy and applicable Shopify privacy materials.
SECTION 10 — PRIVACY
Our collection, use, disclosure, and processing of personal information are described in our Privacy Policy.
Because our store is powered by Shopify, personal information may also be processed by Shopify and applicable service providers as described in that policy.
Where applicable, privacy choices may also be submitted through our Your Privacy Choices page.
SECTION 11 — FEEDBACK AND REVIEWS
If you voluntarily submit reviews, suggestions, ideas, photographs, feedback, or other content ("Feedback"), you represent that you have the rights necessary to submit that content.
To the extent permitted by applicable law, you grant Alpha Moms LLC a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, publish, and distribute Feedback for operating, improving, and promoting the Services.
This license does not override privacy, publicity, intellectual property, or other rights that cannot lawfully be waived.
You may not knowingly submit unlawful, fraudulent, defamatory, infringing, malicious, or materially misleading content.
SECTION 12 — ERRORS AND INACCURACIES
The Services may occasionally contain typographical errors, inaccuracies, or omissions concerning descriptions, pricing, promotions, availability, shipping, transit estimates, or other information.
We may correct errors and update information where reasonably necessary. If a material error affects an order already placed, we will handle the matter in accordance with applicable law, including providing cancellation or refund rights where required.
SECTION 13 — PROHIBITED USES
You may not use the Services:
- for unlawful or fraudulent purposes;
- to violate applicable laws or regulations;
- to infringe intellectual property or other legal rights;
- to transmit malware or malicious code;
- to interfere with the security or operation of the Services;
- to obtain unauthorized access to systems or accounts;
- to scrape or collect personal information unlawfully;
- to impersonate another person or materially misrepresent your identity;
- to engage in spam, phishing, fraud, abuse, or other malicious conduct.
We may suspend or restrict access for violations of these Terms where reasonably appropriate and permitted by applicable law.
SECTION 14 — TERMINATION
We may suspend or terminate access to the Services where reasonably necessary because of a material violation of these Terms, fraud, unlawful activity, security concerns, or other legitimate reasons, subject to applicable law.
Termination does not affect rights, obligations, liabilities, payments, or remedies that accrued before termination or provisions that by their nature should survive.
SECTION 15 — WARRANTIES AND DISCLAIMERS
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT FOR WARRANTIES, GUARANTEES, OR RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED, THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
WE DO NOT WARRANT THAT THE WEBSITE WILL ALWAYS BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
NOTHING IN THIS SECTION EXCLUDES ANY MANDATORY WARRANTY, LEGAL GUARANTEE, CONFORMITY RIGHT, OR OTHER CONSUMER PROTECTION THAT APPLIES TO PRODUCTS PURCHASED FROM US.
SECTION 16 — LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALPHA MOMS LLC AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM THE SERVICES WHERE SUCH LIABILITY MAY LAWFULLY BE LIMITED.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY TO THE EXTENT THAT SUCH LIABILITY CANNOT LAWFULLY BE EXCLUDED OR LIMITED. THIS INCLUDES ANY LIABILITY OR CONSUMER REMEDY THAT APPLICABLE LAW REQUIRES TO REMAIN AVAILABLE.
Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, these provisions apply only to the maximum extent permitted by law.
SECTION 17 — INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless Alpha Moms LLC and its affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, losses, liabilities, and reasonable costs arising directly from your unlawful use of the Services, material breach of these Terms, or infringement of another person's rights.
This section does not create an indemnification obligation to the extent such an obligation is prohibited or unenforceable under applicable consumer law.
SECTION 18 — SEVERABILITY
If any provision of these Terms is held to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed to the minimum extent necessary, while the remaining provisions will continue in effect where legally possible.
SECTION 19 — WAIVER AND ENTIRE AGREEMENT
Our failure to enforce a provision of these Terms does not waive our right to enforce that provision later.
These Terms together with policies expressly incorporated by reference constitute the agreement governing your use of the Services, subject to any mandatory rights or terms imposed by applicable law.
SECTION 20 — ASSIGNMENT
You may not assign your contractual rights or obligations where such assignment would materially affect our rights or obligations, except with our consent or where applicable law gives you a right to do so.
We may assign or transfer our rights or obligations in connection with a merger, acquisition, restructuring, sale of assets, financing, or similar business transaction, subject to applicable law and without reducing mandatory consumer rights.
SECTION 21 — GOVERNING LAW AND INTERNATIONAL CONSUMERS
Subject to the paragraph below, these Terms and our provision of the Services are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.
If you are a consumer residing in a jurisdiction whose mandatory laws give you protections that cannot be waived by contract, this governing-law provision does not deprive you of those mandatory protections.
Nothing in these Terms requires a consumer to waive any mandatory right to bring a claim before a court or other competent authority where applicable law gives the consumer that right.
SECTION 22 — CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes in our Services, business practices, technology, or legal requirements.
The current version will be posted on this page with an updated revision date. Where applicable law requires notice of a material change, we will provide such notice as required.
Changes will not retroactively remove rights that have already accrued where applicable law prohibits doing so.
